Why Are TN Applications Refused at the Border?
Most TN refusals come from a job that does not match a listed profession, a vague employer letter, or intent concerns. Here is how to fix each one.
When a TN visa is denied at the border, the usual reason is that the officer was not convinced the U.S. job belongs to the listed profession claimed. A “computer systems analyst” whose letter describes coding, or a “management consultant” filling a permanent staff role, is the classic example. The other common causes are a degree that does not fit the profession, missing originals or credential evaluations, and signs that the applicant intends to stay permanently. A refusal is rarely the end of the road, but how you respond to it affects every future crossing.
The job does not match the profession
CBP officers read the employer’s letter against the TN profession it names. If the duties sound like a different job, the officer will refuse, even when the applicant is highly qualified. Our list of TN visa professions and their requirements shows how narrow some categories are, and our TN work visa team drafts the letter to fit the category before you reach the border.
The categories that draw the most refusals are computer systems analyst, management consultant, scientific technician and engineer. For each one, the letter must describe duties at a professional level that fit the category’s definition. A software role that is mostly programming should not be presented as systems analysis. A technician must work in direct support of professionals in a listed discipline. An engineer must actually perform engineering, not project coordination or sales.
Credentials that do not fit
The applicant must meet the specific degree or license requirement for the claimed profession, and the degree should be in a field related to the job. A business degree supporting an engineer TN will not work. A three-year degree from outside North America may not be the equivalent of a U.S. bachelor’s, and officers may want a credential evaluation to prove it. Professions that require a license, such as nursing, need the license and, for health care workers, a health care worker certificate.
Bring originals of your degree and transcripts, the evaluation if your degree is from another country, and any license. Missing originals are one of the simplest reasons for a refusal and one of the easiest to avoid.
Intent and other concerns
TN status requires temporary intent. An applicant with an approved immigrant petition, a pending I-485, or answers suggesting a permanent move can be refused on that basis. Be truthful at the border; inconsistent answers about plans or family cause more harm than the underlying facts. Our guide to moving from a TN to a green card explains how to sequence filings to reduce this risk.
Other grounds include self-employment or a job for a company you control, a letter that does not state the length of employment or the pay arrangement, and inadmissibility issues such as certain criminal convictions or prior immigration violations. Canadians with old convictions, including some driving offenses, should check admissibility before applying.
What a TN refusal at the border means
At a port of entry, a refusal usually takes one of three forms:
- The officer refuses the TN and you withdraw your application for admission. This is the most common outcome and does not carry a bar on returning.
- The officer defers inspection and asks you to come back with more documents.
- In serious cases, such as a finding of misrepresentation or lack of proper documents, the officer can order expedited removal, which carries a five-year bar on returning.
For Mexican applicants, a refusal at the consulate is often issued under section 214(b), meaning the officer was not persuaded you qualify, or under section 221(g) when documents are missing. Every refusal is recorded. Applying at a different port of entry does not erase it, and you should expect questions about it at your next application. Our post on what to do after a visa denial covers the broader options.
How to reapply
Start with the reason the officer gave. If it was the job description, have the employer rewrite the letter to describe the actual duties in terms that match the profession, without stretching. If the job truly does not fit, choose a different TN category only if it genuinely applies; otherwise, look at another visa. If it was credentials, get the evaluation, the license or the originals.
Canadians can also ask the employer to file Form I-129 with USCIS. An approved petition presented at the border gives the officer a USCIS decision to rely on, which helps for borderline roles. Mexican applicants can reapply at the consulate with a stronger package.
If the TN is not the right fit, other routes may be: the H-1B for broader professional roles, an L-1 transfer within a company group, or the E-2 treaty investor visa, since both Canada and Mexico are treaty countries. We can review which path fits after a refusal.
