O-1A or H-1B: Which Work Visa Fits Your Record?

The H-1B has a lottery, a degree rule and a six-year clock. The O-1A has none of those but demands proof of sustained acclaim. Here is how to choose.

The H-1B has a lottery, a degree rule and a six-year clock. The O-1A has none of those but demands proof of sustained acclaim. Here is how to choose.

If you lost the H-1B lottery this year, or never entered it because your job does not require your degree, the O-1A is the first alternative to test. Both visas let a U.S. employer put you to work, but they are built on opposite ideas. The H-1B has modest eligibility rules and a hard numbers problem. The O-1A has no numbers problem and a hard evidence problem: you must show that you belong to the small percentage at the top of your field. Choosing O-1A or H-1B is therefore less about preference and more about which set of facts you can document this year. The criteria that decide an O-1A case are laid out on our O-1A extraordinary ability visa page; this article is about the comparison.

O-1A vs H-1B: the five differences that decide it

The cap and the lottery

Congress caps new H-1B visas at 65,000 a year, with 20,000 more reserved for people holding a U.S. master’s degree or higher. Employers register in the spring, USCIS runs a random selection, and an unselected worker waits a full year to try again. The only way around the lottery is an employer that is exempt from the cap, such as a university or a nonprofit research organization; we explain who qualifies in which employers are H-1B cap-exempt. The O-1A has no cap and no registration window. A petitioner can file Form I-129 at any time of year, up to one year before the start date.

The eligibility standard

An H-1B job must be a specialty occupation, meaning it normally requires at least a bachelor’s degree in a specific field, and you must hold that degree or its equivalent. The employer also files a Labor Condition Application with the Department of Labor and commits to pay at least the prevailing wage. The O-1A has no degree requirement, no specialty occupation test and no wage floor. Instead, you must show a major internationally recognized award or satisfy at least three of eight regulatory criteria, and then convince the officer, on the whole record, that you have sustained national or international acclaim. How to prove extraordinary ability for an O-1 visa walks through that evidence criterion by criterion.

Maximum stay

H-1B status is limited to six years in total, usually granted as three plus three. Extensions past six years are possible only when a PERM labor certification or an I-140 petition has been pending or approved for the required period. An O-1A is approved for up to three years for the event or activity, then extended in one-year increments for as long as the same work continues, with no statutory maximum. A new project supports a new three-year petition. See how long an O-1A visa is valid for the mechanics.

Changing jobs

H-1B workers have portability: once a new employer files a non-frivolous petition, you may start work for that employer without waiting for the approval. O-1A workers do not. The new employer or agent must file its own petition and you must wait for the approval notice before you begin. Both classifications carry a grace period of up to 60 days when employment ends early, which gives you time to find a new petitioner or change status.

Family

An H-4 spouse may apply for work authorization once the H-1B worker has an approved I-140 or an extension beyond the sixth year. An O-3 spouse may study but may not work, and there is no O-3 employment authorization as of this writing. For a two-career household this difference can decide the case.

Who should file the O-1A instead of the H-1B

The O-1A fits people whose record already looks like the eight criteria. In practice that means:

  • Researchers with a publication record, citations by others, peer review service and conference invitations.
  • Engineers and product leaders with patents, press coverage, a critical role at a company with a distinguished reputation, or pay well above the field.
  • Executives whose compensation and responsibilities are documented in contracts and organizational charts.
  • Founders, for whom the H-1B employer-employee question is awkward, while the O-1A can be filed by an agent or by a company they own that is a separate legal entity. Can a startup founder get an O-1 visa? explains the structure.
  • Athletes and coaches, who rarely hold a degree that matches a specialty occupation.

The honest tradeoff is effort. An O-1A petition takes weeks to assemble, requires a written advisory opinion from a peer group, and invites a Request for Evidence if the “major significance” of your contributions is asserted rather than shown. If your record is a solid degree and a normal job, the H-1B (or a cap-exempt employer) remains the realistic route, and the H-1B visa for employers covers that process.

Can you pursue both at once?

Yes. Many employers register a candidate for the H-1B lottery and prepare an O-1A in parallel, then file whichever the facts support. If you already hold H-1B status, an O-1A petition can request a change of status, and time spent in O-1 status does not count against the six-year H-1B limit. The reverse also works: an O-1A worker selected in a later lottery can move to H-1B. On immigrant intent, the H-1B is dual intent by statute. The O-1A is not labeled that way, but the regulations state that a pending immigrant petition or approved labor certification is not a basis for denying an O-1 petition, extension or admission, so a green card plan does not sink the case.

A practical way to decide

Ask three questions in order. First, do you have a cap-exempt employer or a lottery selection in hand? If so, the H-1B is usually the faster filing. Second, can you document three O-1A criteria today, with independent evidence rather than letters alone? If yes, the O-1A buys you freedom from the lottery and the six-year clock. Third, where do you want to be in five years? An O-1A record is the same record that supports an EB-1A or EB-2 NIW green card, so the work you do now is reused later. The talent and extraordinary ability visas overview shows how those routes connect, and the H-1B visa page covers the sponsorship side if the lottery route wins.
